– This includes claims where settlements were reached before Court and claims paid out as a result of Court Awards –
Fianna Fáil TD for Louth and East Meath Declan Breathnach has learned that nearly half a billion has been paid out by the Department of Health and HSE in compensation claims since 2011.
“As a result of a Parliamentary Question I asked I learned that €488,734,000 was paid out in the period from 2011 to date in claims finalised by the Health Service Executive,” Deputy Breathnach revealed.
“The majority of the claims were resolved by the State Claims Agency by negotiating a settlement outside of Court, and while this can be seen as cost saving in avoiding a contested Court hearing, we also need transparency and assurance that the settlements were warranted on all counts. From the PQ reply it can be seen that for the entire period €467,646,000 was paid out in settlements agreed and €21,088,000 paid out as a result of Court Awards.”
“While I have been told that a finalised claim refers to when a claim and all other matters associated with it have been agreed, e.g. costs that there may still be some associated payments and reimbursements outstanding on finalised claims.”
“We can see also from the information released by the Department of Health that both the number of claims and the costs associated with negligence claims have increased year on year for the period.”
